Please read these Terms and Conditions ("Terms") carefully before using the Xelami mobile application (the "App") operated by Xelami ("us", "we", or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.
1. Acceptance of Terms
By accessing and using the App, you agree that you have read, understood, and accept all of the terms and conditions contained herein. These Terms apply to all visitors, users, and others who access or use the App.
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal, non-commercial use.
You agree not to:
- Modify, adapt, or hack the App
- Reverse engineer, decompile, or disassemble any part of the App
- Sell, resell, or exploit any portion of the App for any commercial purpose
3. Subscriptions and Payments
Subscription Plans
Our App offers subscription-based access to premium features. The details, pricing, and billing cycle of each subscription plan (e.g., monthly, annually) are provided within the App and on our website.
Billing
Subscription fees will be charged automatically to your designated payment method, and your subscription will automatically renew unless you cancel at least 24 hours before the end of the current subscription period.
Refunds and Cancellations
All subscription purchases are non-refundable, except as required by applicable law. You may cancel your subscription at any time, but access to premium features will continue until the end of your current billing period.
4. Use of the App
User Account
To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
User Conduct
You agree not to use the App for any unlawful purpose or in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use and enjoyment of the App.
Content
The App may allow you to input or generate content (e.g., language practice interactions). You retain ownership of your content but grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, modify, and distribute such content for the purpose of operating, promoting, and improving the App.
5. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of Xelami or its licensors and are protected by applicable intellectual property laws. Unauthorized use of the content may violate copyright, trademark, and other laws.
6. Disclaimers
No Warranty
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, or completely secure. All warranties, express or implied, are disclaimed to the fullest extent permitted by law.
Limitation of Liability
In no event shall Xelami, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
7. Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of changes by posting the new Terms on the App or website. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
8. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately. All provisions of these Terms that by their nature should survive termination will remain in effect.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United Kingdom without regard to its conflict of law provisions. Any disputes arising in connection with these Terms shall be resolved exclusively in the courts located in the United Kingdom.
